RESTRICTIONS OF THE RIGHTS AND FREEDOMS OF FOREIGN CITIZENS AND PERSONS
WITHOUT CITIZENSHIP AS ELEMENT OF SAFETY RELATED SYSTEM NATIONAL SECURITY
OF THE RUSSIAN FEDERATION

Abstract.
Subject of this research is restrictions of the rights and freedoms of foreign citizens and persons
without citizenship. The purpose of wok consists in research of institute of restriction of foreign citizens and persons
without nationality as one of basic elements of ensuring national security. The urgency of a subject is caused, first of all,
by interests of national security. By entering this legal institute, the state protects itself from negative impact of foreign
citizens which to certain qualities can negatively affect social, economic, political foundations and safety of Russia as a
whole. The author analyzed regularity legal base, position of the Constitutional Court of the Russian Federation and the
Supreme Court of the Russian Federation concerning restrictions of the rights and freedoms of foreign citizens. The
author demonstrated the need to use a broad-gauge line to the concept "restriction of the rights and freedoms" taking
into account the received results of the analysis of court practice and scientific approaches of this theme. The idea that
ensuring national security is a paramount task of the state is specified in this work, thus even the rights and freedoms of
foreign citizens cannot be put on «a bowl of scales» which would move interests of the personality, society and the
state. Thus, in interests of national security the state has the right to establish necessary restrictions concerning foreign
citizens, up to application of repressive methods in case of a need. In, the conclusion of wok author gave in his work a
legal definition to the term «restriction of the rights and freedoms of foreign citizens in the interest national security»,
and also elicited factors from which depend up restriction of the rights and freedoms of the foreign citizens who are
lawfully stay in the territory of the Russian Federation.
